1. The instant petition has been filed by the petitioner under Section 438 of Cr.P.C. for grant of anticipatory bail in case FIR No.0244 dated 28.04.2022 registered under Sections 406, 420 and 120-B of IPC at Police Station Karnal Civil Lines, District Karnal, Haryana.
2. This Court vide order dated 27.05.2022 had directed the petitioner to join the investigation and he was ordered to be released on interim bail to the satisfaction of Investigating/Arresting Officer subject to his abiding the conditions envisaged under Section 438 (2) of Cr.P.C.
3. Today, learned counsel for the petitioner has submitted that the petitioner has already joined the investigation in pursuance of order dated 22.05.2023.
4. Learned State counsel, on the other hand, while opposing the prayer and submission made by learned counsel for the petitioner, has submitted that no doubt, the petitioner has joined investigation in compliance of previous order, however, he has not cooperated as the whereabouts of the co-accused who is yet to be arrested, have not been divulged by him. Therefore, he argued that the petitioner does not deserve to be extended benefit of anticipatory bail.

The non-disclosure of the co-accused's whereabouts was not sufficient grounds for denial of anticipatory bail.
