2021 Supreme(All) 742

IN THE HIGH COURT OF ALLAHABAD
IRSHAD ALI, J.
Ashok Kumar Singh – Petitioner
Versus
State of U.P. and Another – Respondents
Service Single No. 12120 of 2021
Decided On : 19-07-2021

Advocates:
Advocate Appeared:
For the Petitioners: Sameer Kalia, Srideep Chatterjee.

Point of Law: Suspension order - Disciplinary authority could have recorded its satisfaction while passing order of suspension against an employee of State Government - It is evident that order does not contain satisfaction to arrive at conclusion that charges levelled against petitioner is sufficient to impose major penalty

Headnote:

U.P. Government Servant (Discipline and Appeal) Rules, 1999 - Rule 4 - Disciplinary authority - Power of suspension - Post of Joint Commissioner Commercial Tax - Major penalty

- Prayer for issuance of writ of mandamus commanding respondents not to give effect the impugned order with further prayer to allow petitioner to work and function on post of Joint Commissioner (SIB), and also pay him regular salary as and when same became due.

Finding of the court: is evident that the disciplinary authority would record reasons and satisfaction in the suspension order against an employee - Election Commission as well as the Commissioner Commercial Tax, it is evident that the respondent no. 1 merely relied upon the orders of the Election Commission and Commissioner Commercial Tax and has proceeded to pass the impugned order - Respondents while passing the impugned order of suspension has failed to record reasons to arrive at conclusion of satisfaction that the charges are serious enough to impose major penalty.

Result: Writ Petition allowed.
