For the Respondents:Mr. B.D. Upadhyay, learned Sr. Advocate assisted by Ms. Mamta Bisht, learned counsel, Mr. C.S. Rawat, learned counsel, Ms. Pooja Banga, learned Brief Holder.

Ad hoc service should be considered for financial benefits, including arrears of salary, as approved by the State Government.

Headnote:

ad hoc service - grant of financial benefits - U.P. State Universities Act, 1973, Government Order dated 07.01.1989, Government Order dated 30.06.1992, Government Order dated 16.05.2017

Fact of the Case:

The petitioner, a Lecturer (Chemistry), sought the computation of his ad hoc service for re-fixation of salary and release of arrears of salary. The State Government's decision on 16.05.2017 approved the ad hoc service for the purpose of granting seniority and promotion.

Finding of the Court:

The petitioner is entitled to the relief sought as the ad hoc service should be considered for financial benefits, including arrears of salary. The inaction of the respondents led to the petitioner invoking the jurisdiction of the Court.

Issues: The main issue was the computation of ad hoc service for the re-fixation of the petitioner's salary and the release of arrears of salary.

Ratio Decidendi: The ad hoc service of the petitioner should be computed for the re-fixation of his salary, and arrears of salary should be released within three months from the date of the court order.

Final Decision: The writ petition is allowed, and a writ of Mandamus is issued to the respondents to compute the ad hoc service of the petitioner for re-fixation of his salary and release arrears of salary within three months. The petitioner is entitled to penal interest at the rate of 6% per annum if the exercise is not completed within the stipulated period.
