Land Revenue Code, 1959 (M.P.) -- Ss. 44 (1) and 89 -- jurisdiction -- original order passed by Sub Divisional Officer under section 89 -- first appeal lies before Collector, not Additional Commissioner -- order passed by Additional Commissioner in first appeal against original order of SDO is without jurisdiction and void -- such order can be challenged in any proceedings -- set aside in second appeal by Board of Revenue -- liberty granted for filing first appeal before Collector -- delay of time spent in such proceedings condoned. In Ledgard v. Bull, [1886] Law Report, 13 AC, 134 the privy Council laid down that where the original Court in a suit was inherently lacking jurisdiction, and was incompetent to try the same, on its transfer by consent of parties, to a Court with jurisdiction such consent did not operate as waiver of the plea of want of jurisdiction. In Bartan v. Fincham, [1921] 2 Kings Bench Division, 291 at 299 it was held that:
''Parties cannot by agreement give the Courts jurisdiction which the Legislature has enacted they are not to have. The Court cannot give effect to an agreement whether by way of compromise or otherwise, inconsistent with the provisions of the Act.''

A decree passed by a Court without jurisdiction over the subject matter or on other grounds which goes to the root of its exercise or jurisdiction, lacks inherent jurisdiction. It is a corum non judice. A decree passed by such a Court is a nullity and is non est. validity can be set up whenever it is sought to be enforced or is acted upon as a foundation for a right, even at the stage of execution or in collateral proceedings. The defect of jurisdiction strikes at the authority of the Cout to pass a decree which cannot be cured by consent or waiver of the party. (Emphasis added)
