By way of present petition, the petitioner herein has prayed for quashing and setting aside the order dated 21.11.2019 passed by the President, Maintenance Tribunal and Sub-Divisional Magistrate (East), Ahmedabad in Parent Act – Appeal No.23 of 2019.

2. The brief facts leading to the filing of the present petition read thus:—

2.1 The petitioner herein is daughter-in-law of the respondent No.1. The respondent No.1 had written a letter to the District Collector, Ahmedabad, which narrated that the respondent No.4 (husband of the petitioner herein and son of the respondent No.1) is residing illegally in the property of the respondent No.1 and requested the Collector to handover the possession of the property-in-question, which is a residential property being 1/A, 1st Floor, Bhartiyanagar Co. Op. Housing Society, Gordhanwadi Cross Road, Kankaria, Ahmedabad, from the respondent No.4 i.e. husband of the present petitioner, under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (as Amended in 2019).
