ORDER :
C.V. BHASKAR REDDY, J.
The issues involved in both these writ petitions are intrinsically interconnected and hence, they are taken up and heard together and are being disposed of by this common order.
2. Writ Petition No.3698 of 2023, under Article 226 of the Constitution of India , is filed by the petitioners, seeking the following relief:
“…to issue an appropriate order, writ or direction more particularly one in the nature of writ of mandamus declaring the revised layout permit No.2755/Layout/CDA/PLG/HMDA/2002, dated 26.04.2013 and permit No.39591/HO/WZ/Cir.-11/2015, dated 20.01.2015 in File No.B/4
Development authorities must adhere to original layout approvals, and changes affecting community rights without due process are illegal.
The court affirmed that property disputes should be resolved in civil courts, not through writ petitions, emphasizing the limited role of municipal authorities in such matters.
Rejection of layout regularization invalid without comprehensive inspection verifying pre-cut-off formation beyond sale deed recitals.
