Eligibility for Selection and Special Grade compensation for teachers is determined by service rendered before a statutory cutoff, upheld by higher judicial authority, barring reconsideration on procedural grounds.

Headnote:(A) Education Department - Selection Grade and Special Grade Eligibility - The issue at hand concerns the eligibility of Secondary Grade Teachers and Primary School Head Masters for receiving Selection and Special Grade compensations based on their service duration. The court referenced prior case law where the benefit of service prior to 1.6.1988 had been contested, resulting in a dismissal of appeals by the Supreme Court confirming the lower court's decision. (Paras 1-4)

(B) Laches and Time Bar - The court noted that claims presented were subject to time latches due to the implementation of the V Pay Commission on 1.6.1988, emphasizing the absence of grounds for reconsideration after the Supreme Court upholding the Division Bench's previous orders. (Paras 2-3)

Facts of the case:
This batch of writ appeals arises from concerns by retired teachers regarding their entitlements to selection and special grade pay scales, previously denied based on various procedural grounds, overlapping timelines, and legal principles surrounding the implementation of pay scales as per government orders.

Findings of Court:
The court affirmed the dismissals of various writ petitions and upheld the Division Bench's earlier ruling, noting that claims were unable to be revisited due to procedural delay and existing Supreme Court confirmations.

Issues: The crux of the issues addressed involved the right to reckon previous service for pay grade enhancements under former employment conditions, including statutory timelines—supporting significant claims surrounding educational employment law.

Ratio Decidendi: The ruling reinforced that once a Supreme Court order is rendered, it becomes precedential, and lower courts must adhere to such authoritative conclusions without re-examination unless significant new evidence emerges.

Result: Writ Appeals allowed for government claims; all other writ appeals and petitions dismissed.

JUDGMENT :

S.M. Subramaniam, J.

The issue in these batch of Writ Appeals are no longer res integra. The issue pertains to grant of Selection Grade and Special Grade to the post of Secondary Grade Teachers and Primary School Head Masters in the Education Department. Whether the services rendered as Secondary Grade Teacher prior to 01.06.1988 shall be reckoned for grant of Selection Grade or not was considered by the Courts.

2. The Division Bench has passed an order rejecting the claim of the Secondary Grade Teachers and a batch of appeals were filed by the aggrieved teachers before the Hon’ble Supreme Court of India and the order of the High Court was confirmed and the Special Leave Petition was dismissed on 01.04.2019 in SLP.(Civil) Diary No.5529 of 2019. Therefore, no further adjudication needs to be undertaken, since all the present batch of writ appeals are covered by the order of the Division Bench, which was confirmed by the Hon’ble Supreme Court of India.

3. That apart, Courts have rejected the Writ Petitions on the ground of latches, since the benefit claimed pertain to V Pay Commission, which came to be implemented on 01.06.1988. Thereafter, three Pay Commissions were implemented and pay fixed to the teachers were merged and revised pay was fixed. Under these circumstances, the Courts rejected the petitions and now there is no scope to re-consider the same, since the judgment of the Division Bench was confirmed by the Hon’ble Supreme Court of India.

4. Consequently, the Writ Appeals filed by the Government viz., W.A.Nos.375, 710, 1001 of 2019, 2423 of 2013, 1243 of 2015 and 763 of 2016 are allowed and all the other Writ Appeals and Writ Petitions are dismissed. No costs. Consequently, the connected miscellaneous petitions are closed.
