The school in question falls under the above specified category and to this extent, there is no dispute. In fact, the school has also earmarked 25% of the strength in first class for admission to a child covered under the Act. 8. By the above provision, it is the responsibility of the school specified in sub-Clauses (iii) and (iv) of Clause (n) of Section 2 of the Act to admit the children belonging to weaker section and disadvantaged group in the neighbourhood in Class-I to the extent of at least 25% of the strength of that Class.
The expression "Government School" can thus only mean a School established and run by the Government. However there is absolutely nothing before us to show that the respondent School was established or is run by the Govt. Rather it is the unrebutted statement of the respondent that the respondent School was established by the Indian Air Force Educational and Cultural Society the presumption in law follows that it is being managed by the Managing Committee in terms of Section 5 of the DSE Act.
(a) When the term "first recognized High School" is not defined, it has to get the plain and simple dictionary meaning thereof. Thereafter any controversy, if any, would be a factual controversy and that can be resolved by the competent authorities either on administrative side or alternately on judicial forum as provided under law. Which High School is first recognized by the Government. Once the dispute is in respect of claim and entitlement of grant-in-aid, that comes within the jurisdiction of Orissa Education Tribunal under Section 24-B of the Act.
4. Admittedly the school in question is a minority school aided by the Government and run by a trust. The school is also governed by the provisions of Bihar Non-Government Elementary Schools (Taking over Management and Control) Act, 1976 and the rules framed thereunder. In such circumstance it cannot be held that the action of the Managing Committee is not subject to judicial review.
