However, a contract to purchase immovable property by a competent guardian acting within his authority on behalf of a minor is specifically enforceable by or against the minor, as the guardian has the legal competency to enter into such a contract for necessity or for the benefit of the estate. The doctrine of mutuality is satisfied because the contract is valid from inception and either party can enforce it. 2021 0 Supreme(Bom) 248 : When a contract involves minors, the entire transaction may be void only if it is a family settlement, as per the Supreme Court''''s ruling in Mohd. Amin (supra). However, in cases where the contract is divisible and some vendors are competent to contract (sui juris), the contract can be validly enforced against those competent vendors, even if others are minors. The transaction is void only in respect of the minors'''' shares, not the entire agreement. This principle applies particularly when the property is susceptible to partition and there is no impediment to enforcing the contract against the major vendors. Thus, the effect of a minor''''s involvement is limited to their own share, and the contract remains enforceable against the competent parties.
