In the present case, the plaint itself was filed on the last date of limitation and the plaintiff should have been vigilant enough to pay the Court fee in entirety and there is no justification on his part to make the Court to return his plaint for affixing deficit Court fee. In this context, it has to be construed that if the return of the plaint happened at the behest of the plaintiff, the plaint should be deemed to have been barred by limitation.
