I am of the view that the said decision is distinguishable on facts. Both these cases support the proposition that there cannot be any unilateral determination or realization of penalty or damages by a party to a contract without any adjudication. There is no quarrel with the proposition laid down in the decisions reported in Gangotri Enterprises Ltd. vs. Union of India & Ors., (2016) 11 SCC 720 and Kailash Nath Associates vs. Delhi Development Authority & Anr., (2015) 4 SCC 136.
