2025 Supreme(AP) 1220

IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
B.V.L.N. CHAKRAVARTHI, J.
Yacobu S/o Yelia – Appellant
Versus
The State of Andhra Pradesh – Respondent
Writ Petition No. 19804 of 2019
Decided On : 24-11-2025

Advocates Appeared:
For the Appellant : Painti Suresh
For the Respondent: Y. Jaya Raju

A writ petition alleging police inaction is rendered infructuous if an FIR is subsequently registered, displaying the principle that legal proceedings must have ongoing relevance.

Headnote:(A) Indian Penal Code - Sections 447, 427, 506 r/w 34 - Writ petition alleging police inaction in registering an FIR was rendered infructuous after the police registered a case based on the petitioner's report, leading to the dismissal of the petition. (Paras 2, 4)

(B) Infructuous Writ Petition - The court dismissed the writ petition as infructuous due to the registration of the FIR post-petition submission, emphasizing that no further action was necessary. (Paras 2, 4)

Facts of the case:
The petitioner claimed that the police did not register an FIR despite a report sent via registered post. Following the report, the police registered a case based on the petitioner’s submission, rendering the petition no longer necessary.

Findings of Court:
The court concluded that the registration of the FIR by the police made the writ petition unnecessary, leading to the dismissal of the case.

Issues: The primary issue was whether the police's registration of the FIR rendered the writ petition redundant.

Ratio Decidendi: The court held that the actions taken by the police subsequent to the writ petition’s submission resolved the grievances raised, thus making the petition infructuous.

Result: Writ petition dismissed as infructuous.
