Versus
The State Of Andhra Pradesh, rep. By Its Principal Secretary, School Education Department and Ors. – Respondents
Writ Appeal No. 1043 of 2025
Decided On : 27-10-2025

Advocates Appeared:
For the Appellant : Gundala Siva Prasada Reddy
For the Respondents: GP for Services II

The court emphasized proper procedural conduct in managing writ petitions, allowing parties to address their concerns directly with the original bench.

Headnote:(A) Constitution of India - Article 226 - Writ Appeal - The appeal challenges an order directing the posting of a writ petition with connected matters, which the appellant argues was not requested by him. The learned court found that it's appropriate to advise the appellant to make submissions before the single judge. (Paras 1-4)

(B) Writ Jurisdiction - The exercise of writ jurisdiction allows the court to direct that proceedings be handled efficiently and without unnecessary delay. (Para 5)

Facts of the case:
The present Writ Appeal contests an order that involved a procedural aspect of listing a writ petition alongside other related matters, with the appellant asserting no request was made for such a listing.

Findings of Court:
The court prefers to encourage the appellant to address his concerns directly with the single judge while allowing for the proceedings to be expedited based on proper requests.

Issues: The main issue pertains to whether the appellant has the right to contest the procedure by which his writ petition was ordered to be posted with connected petitions.

Ratio Decidendi: The court held that procedural inefficiencies must be addressed within the framework of existing court protocols, emphasizing the importance of effectively managing case listings.

Result: Writ Appeal disposed of with no order as to costs.

JUDGMENT :

Battu Devanand, J.

This Writ Appeal is filed against the order, dated 01.09.2025 in W.P.No.30928 of 2023 passed by the learned Single Judge of this Court wherein considering the request of the learned counsel for the petitioners, directed to be posted the writ petition along with W.P.Nos.30879 and 30917 of 2022 after obtaining permission from the Hon’ble the Chief Justice. Aggrieved by the said order, the present writ appeal is filed.

2. Sri G. Siva Prasad Reddy, learned counsel for the appellant, would submit that he never requested the learned single Judge to post W.P.No.30928 of 2023 along with connected W.P.Nos.30879 and 30917 of 2022. But, the learned single Judge erroneously directed the Registry to post W.P.No.30928 of 2023 along with connected W.P.Nos.30879 and 30917 of 2022 after obtaining permission from the Hon’ble the Chief Justice.

3. During the course of hearing of this writ appeal today, the learned counsel for the appellant would submit that already after obtaining permission from the Hon’ble the Chief Justice, W.P.No.30928 of 2023 is listed before the concerned learned single Judge having roster along with connected matters, but it could not reached.

4. In the aforesaid circumstances, in our view, it is appropriate to dispose of this writ appeal with advice to the learned counsel for the appellant to make all submissions before the learned single Judge. The learned counsel for the appellant is at liberty to make his request before the concerned Bench having roster to take up writ petition for early hearing.

5. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
