IN THE HIGH COURT OF DELHI
D.N. Patel, Jasmeet Singh, JJ.
Sarv Priya Mahajan CGHS Ltd. - Appellant
Versus
Registrar of Co-operative Societies - Respondent
W.P.(C) 5020 of 2021
Decided On : 27-04-2021

The court affirms the role of timely administrative decisions in cooperative matters, allowing petitions to seek resolutions rather than solely quashing administrative actions.

Headnote:(A) Cooperative Societies Act - Appointment of administrator - Writ petition for quashing the appointment of administrator cum Returning Officer - Petition disposed directing authorities to decide representation dated 16th April 2021 in accordance with applicable law and previous judgment. (Paras 6-10)

(B) Writ jurisdiction - Scope of interference in administrative actions - A writ petition can seek directions for timely resolution of pending representations rather than directly quashing administrative decisions. (Paras 8-10)

Facts of the case:
The petitioner sought to quash an order appointing an administrator for their society, contending it contravened procedures regarding the appointment of a Returning Officer.

Findings of Court:
The petition was disposed of with a direction for the timely decision on the representation submitted by the petitioner.

Issues: Whether the appointment of the administrator was lawful and if the petitioner's representation could lead to a reconsideration.

Ratio Decidendi: The court emphasized the importance of deciding representations in a timely manner while highlighting that a writ petition can effectively seek such administrative resolutions rather than outright reversals of decisions.
