JUDGMENT :
ROBIN PHUKAN, J.
1. Heard Mr. R. Goswami, learned counsel for the appellant and also heard Mr. S.N. Krishnatraya, learned counsel for the respondent No.1/claimant.
2. This appeal under Section 173 of the MOTOR VEHICLES ACT , 1988 is directed against the judgment and award dated 06.01.2020 passed by the learned Member, Motor Accident Claims Tribunal (MACT), Nalbari, in MAC Case No.240 (Injury)/2017, filed under Section 166 of the M.V. Act. It is to be noted here that vide impugned judgment and award dated 06.01.2020, the learned Member, MACT, Nalbari, has directed the appellant herein to pay a sum of Rs.8,57,900/- being the compensation in favour of the respondent No.1/claimant within 60 days from the date of pronouncement of the judgment with interest @ 6% per annum from the date of filing of the claim petition on
Compensation determination must reflect the realities of the victim's situation, taking account of unchallenged testimony even in the absence of documentary evidence.
