S.M.SUBRAMANIAM
J. Ananthajothi – Appellant
Versus
State of Tamil Nadu Represented by it's Secretary, Health and Family Welfare Department, Chennai – Respondent
The relief sought for in this writ petition is to direct the third respondent to consider the appointment of the petitioner as Hospital worker and allow her to participate in the recruitment process for Hospital Workers and appoint her to the Post of Hospital Worker with consequential benefits.
2. The learned counsel appearing on behalf of the writ petitioner states that the writ petitioner was employed as Hospital worker on contract basis with effect from 01.11.2003. He further states that the initial appointment of the writ petitioner was not made through the selection process. Admittedly, the Rules relating to the recruitment was not followed, while appointing the writ petitioner on temporary basis. The claim of the writ petitioner is that she is working for long years and vacancies are also available and therefore, the services of the writ petitioner ought to have been regularised. He further states that the respondents are initiating steps to fill up the post of Hospital Worker and the similarly placed persons were already considered and benefit of regularisation was extended to those similarly placed persons. Thus, the writ petitioner also deserves to be considered.
