JUDGMENT
1. The present Contempt Petition has been filed for the alleged violation of the directions contained in the order dated 6th April, 2022 passed by this Court in W.P.(C) No.289 of 2011.
2. At the time of hearing, Mr. Samantaray, learned Additional Government Advocate states that the petitioner in compliance of the directions has since been promoted as Deputy Superintendent of Police (DSP) with retrospective effect from the date of promotion of his juniors. He further states that the consequential refixation of pay and release of revised pensionary benefits would take some substantial time but exercise completed not later than three months from today.
3. In view of the above, learned Proxy Counsel appearing on behalf of the petitioner has no objection if the present Contempt Petition is disposed of as infructuous.
4. Accordingly, the present Contempt Petition stands disposed of as infructuous.
However, liberty is granted to the petitioner to seek its revival, in case, the admissible revised pensionary benefits are not released by 30th April, 2023 by making a proper application.
Compliance with court orders and directions is essential to avoid contempt proceedings.
