Civil Courts lack jurisdiction under Section 145 of the Electricity Act, 2003, with consumers having alternative remedies available, including writ petitions for challenging orders.

Headnote:(A) Electricity Act, 2003 - Section 145 - Jurisdiction of Civil Court - The Court examined jurisdictional limitations placed by the Electricity Act, determining that the Civil Court lacks jurisdiction due to the bar under Section 145, though a writ petition may be pursued to challenge the impugned order (Para 1).

(B) Consumer Remedy - The case establishes that consumers have alternative remedies outside the Civil Court for disputes related to the Electricity Act (Para 1).

Facts of the case:
The appellant challenged the jurisdiction of the Civil Court concerning a dispute with the Sub Division Officer, referencing a prior decision by a Co-ordinate Bench.

Findings of Court:
The appeal was decided affirmatively based on the precedent set in RSA-4181-2016.

Issues: The Court addressed whether the Civil Court has jurisdiction or if consumers possess alternative remedies under the Electricity Act.

Ratio Decidendi: The Court concluded that due to the specific bar on Civil Court jurisdiction outlined in Section 145 of the Electricity Act, consumers are required to seek remedies through writ petitions for validity determinations.

Result: Appeal decided in accordance with the prior ruling.
