JUDGMENT :

Ravindra Maithani, J.

The instant revision is preferred against the following:-

(A) judgment and order dated 13.11.2014, passed in Criminal Case No.480 of 2010, State Vs. Nar Singh Gupta, by the court of Additional Chief Judicial Magistrate, Haridwar, District Haridwar (“the case”). By it, the revisionist has been convicted under Sections 323 and 452 IPC and sentenced as hereunder:-

(i) Under Section 323 IPC, 3 months’ simple imprisonment and a fine of Rs. 1000/-. In default of payment of fine, rigorous imprisonment for a further period of 10 days.

(ii) Under Section 452 IPC, 6 months’ simple imprisonment and a fine of Rs. 4,000/-. In default of payment of fine, rigorous imprisonment for a further period of one month.

(B) Judgment and order dated 22.02.2023, passed in Criminal Appeal No.162 of 2014, Nar Singh Gupta Vs. State, by the court of 1st Additonal District and Sessions Judge, Haridwar, District Haridwar (“the appeal”), by which, the appeal has been dismissed and the conviction and sentence passed in the case, has been upheld.
