JUDGMENT
Arindam Lodh, J. - Heard Mr. Somik Deb, learned senior counsel assisted by Mr. T. Debbarma, learned counsel appearing for the petitioner. Also heard Mr. D. Bhattacharjee, learned G.A. assisted by Mr. S. Saha, learned counsel appearing for the respondents-State.
2. The subject matter of the instant writ petition is squarely covered by a decision of this court passed in WP(C) No.21 of 2023, where the court directed the respondents to recast/rearrange the select list as regards to Bengali subject. The instant writ petition also relates to Bengali subject and similar prayer has been made in this writ petition.
3. In view of the direction passed in WP(C) No.21 of 2023, Mr. Deb learned senior counsel has not pressed this petition.
4. Accordingly, the instant writ petition stands disposed as withdrawn with liberty to the petitioner to approach the court, if he is aggrieved of the selection process.
The court upheld prior rulings, allowing withdrawal of a similar writ petition while preserving the petitioner's right to challenge future selections if aggrieved.
The recruitment process must ensure equal treatment of all candidates, upholding constitutional principles of fairness and non-discrimination.
The absence of a legal provision for revaluation of answer sheets in recruitment processes limits the court's ability to intervene in evaluation disputes.
