1. This is a First Appeal preferred by the Plaintiff No. 2 challenging the Judgment and Decree dated 10.11.1998 passed in O.S. No. 609 of 1981 on the file of the V-Senior Civil Judge, City Civil Court, Hyderabad, thereby dismissing the Suit for Declaration of Title and Injunction.

2. Heard learned Senior Counsel, Sri. M. Surendar Rao, appearing for Sri. M. Sharath Kumar, learned Counsel for the Appellants; learned Advocate General appearing for Respondent Nos. 1 and 2/Defendants and Sri. Ashok Kumar Agarwal, learned Counsel for Respondent No. 4.
