Constitution of India, 1950 – Article 14, 16, 226 – Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 – Section 107 – Regulation 1947 – Section 10 – Requisition and Acquisition of Immoveable Property Act, 1952 – It is submitted at Bar that since common questions of law are involved in all these petitions, same may be heard and disposed of together at this admission stage itself, by passing a common judgment and order – And accordingly, it is decided to hear arguments of learned Advocates of all parties and to dispose of petitions, by this common judgment and order – Held, Court find sufficient merit in these petitions and, accordingly – Admittedly, state respondents have already paid compensation to petitioners herein, under Regulation 1947 – In addition to said compensation amount, petitioners are entitled to solatium and interest – By a mandamus of this court, state respondents are directed to work out and make payment of solatium and interest to petitioners, as provided in RFCT & LARR Act, 2013, and under Notifications, presently holding field – Petitioners shall obtain a certified copy of this judgment and order and place same before respondent authorities – On receipt of certified copy respondent authorities shall carry out above exercise within a period of two months from date of receipt of certified copy – Writ petitions disposed of.
JUDGMENT :
ROBIN PHUKAN, J.
1. These three writ petitions, under Article 226 of the Constitution of India, have been preferred by the petitioners for issuance of a writ in the nature of Certiorari and/or Mandamus and/or any other appropriate writ, order or direction of like nature, directing respondent authorities for payment of solatium amount to the petitioners, at the rate of 100% of the compensation amount, under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
2. It is submitted at the Bar that since common questions of law are involved in all these petitions, the same may be heard and disposed of together at this admission stage itself, by passing a common judgment and order. And accordingly, it is decided to hear arguments of learned Advocates of all the parties and to dispose of the petitions, by this common judgment and order.

State legislation cannot provide lesser compensation than that guaranteed under parliamentary law, rendering it repugnant and unconstitutional.
The acquisition process does not lapse under section 24(2) of the 2013 Act if compensation has been tendered to the landowners and possession of the land has been taken by the acquiring authority.
The Supreme Court ruled Section 3-J of the National Highways Act unconstitutional, affirming landowners' right to solatium and interest, recognizing it as a constitutional obligation of the State.
Concluded acquisitions under the old regulation preclude reopening for additional compensation, including Solatium, after acceptance of initial compensation.
