Decided On : 20-11-2021

Advocates appeared:
Mahaveer Singh, Advocate, Laxman Solanki, Advocate

The court established that typographical errors in legal documents can be corrected to ensure the accuracy of court records.

Headnote:

[CORRECTION] - [F.I.R. Number] - [The court allowed the application for correction of the F.I.R. number due to a typographical error, emphasizing the importance of accuracy in legal documents and ensuring that the correct F.I.R. number is reflected in the court's records.]

Fact of the Case:

The petitioner sought a correction in the F.I.R. number mentioned in a previous court order due to a typographical error.

Finding of the Court:

The court acknowledged the inadvertent error and allowed the correction of the F.I.R. number from 'F.I.R. No.122/2020' to 'F.I.R. No. 122/2021'.

Issues: Whether the court should allow the correction of the F.I.R. number due to a typographical error.

Ratio Decidendi: The court held that accuracy in legal documents is crucial and permitted the correction to reflect the true F.I.R. number.

Result: The application for correction was allowed, and the F.I.R. number was amended accordingly.

JUDGMENT

Rameshwar Vyas, J. - The matter comes upon an application seeking correction in the F.I.R. number as reflected in the order dated 16.11.2021 passed by this Court in S.B. Criminal Misc. 2nd Bail Application No. 15405/2021.

2. Heard learned counsel for the parties on the application.

3. It is submitted by learned counsel for the petitioner that due to inadvertance and typographical error, in the cause title of the bail application, the F.I.R. number has wrongly been mentioned as "F.I.R. No.122/2020", whereas, correct F.I.R. number is "F.I.R. No. 122/2021". It is prayed that the F.I.R. number as mentioned in the order dated 16.11.2021 may be rectified.

4. For the reasons mentioned in the application, the same is allowed. The F.I.R. number i.e. "F.I.R. No.122/2020" as reflected in the order dated 16.11.2021 be now read as "F.I.R. No. 122/2021".
