Administrative experience as Hospital Administrator is equivalent to teaching experience for promotion to Assistant Professor under amended rules.

Headnote:

(A) Himachal Pradesh Medical Education Service Rules, 1999 - Amendment of 15.10.2018 - Promotion to Assistant Professor - Petitioner, with requisite qualifications and experience, challenged the non-consideration for promotion despite being the only eligible candidate - Court emphasized the need for adherence to the amended rules and proper conduct of DPC. (Paras 1, 8, 10, 26)

(B) Administrative Experience - The court recognized that three years of administrative experience as Hospital Administrator is equivalent to teaching experience for promotion to Assistant Professor, as per the amended rules. (Paras 14, 20)

(C) Procedural Fairness - The court highlighted the importance of timely DPC meetings and the need to consider candidates based on eligibility at the time of vacancy. (Paras 22, 24)

Facts of the case:
The petitioner, a qualified medical professional with a Master's in Hospital Administration, claimed eligibility for promotion to Assistant Professor based on his administrative experience, which was not recognized by the DPC.

Findings of Court:
The court found that the petitioner was indeed eligible for promotion and that the DPC had failed to consider him without valid justification.

Issues: The main issues included the eligibility of the petitioner for promotion and the procedural lapses in convening the DPC.

Ratio Decidendi: The court ruled that the petitioner’s administrative experience should be considered equivalent to teaching experience for promotion, and that the DPC must adhere to the amended rules.

Result: The court quashed the DPC's minutes and directed the respondents to consider the petitioner for promotion.
